What is My Miami Uber Accident Case Worth?

One of the most common questions clients ask after an accident involves the amount of compensation they will receive for their injuries.  The answer is that every case is unique.  The value of your Uber accident claim will depend upon multiple factors, including:

  • The severity of the injuries you have sustained
  • The nature of any disruptions to your career, education or quality of life
  • The cost of your medical treatment, including future medical care
  • Your emotional and physical pain and suffering

The availability of insurance coverage also plays a role in determining the value of any personal injury claim.  In that respect, accidents involving rideshare companies are different from other car accidents in Miami.

Uber drivers are classified as independent contractors.  Because of that, Uber can’t technically be held liable when they cause an accident.  However, Florida state law requires Uber to purchase commercial insurance coverage to protect injured parties in an accident.  The value of that insurance depends on the driver’s status at the time of the accident.

Driver Has Accepted a Ride Request

A $1 million insurance policy applies from the moment the Uber driver accepts a ride.

Coverage includes:

  • $1 million in third-party liability
  • uninsured/underinsured motorist coverage
  • Contingent collision coverage

The policy remains in force while the driver is en route to pick up the passenger and while the passenger is in the Uber vehicle.

Driver is Available to Accept a Ride Request

A different policy applies if the Uber driver is logged into the Uber app, but has yet to accept a passenger.  As long as the driver is available to accept ride requests, Uber insurance covers:

  • $50,000 in bodily injury per victim
  • $100,000 in bodily injury per accident
  • $25,000 in property damage per accident

The Uber policy provides secondary coverage.  In other words, it kicks in to cover costs that a personal insurance policy doesn’t cover.

Driver is Not Available to Accept a Ride Request

If the driver isn’t logged into the Uber app and available to accept a ride, the driver’s own personal car insurance will apply.  The rideshare company isn’t involved in these cases at all–because the driver is using the vehicle for personal purposes.

What Types of Damages Are Available to Uber Accident Victims?

Depending upon the type of loss, damages in Florida are classified as economic or non-economic in nature.

Economic damages cover your expenses.  In most cases, you’ll be entitled to receive compensation for:

  • Past and future medical expenses
  • Lost wages
  • Reduced earning potential
  • Physical therapy
  • Property damage

Non-economic damages compensate for your emotional trauma and physical pain.  Most Uber accident victims may be entitled to receive damages for:

  • Pain and suffering
  • Mental anguish
  • Physical disfigurement and scarring
  • Anxiety, depression and PTSD
  • Diminished quality of life
  • Loss of consortium

Can I Recover Damages If I’m Being Blamed for an Uber Accident in Florida?

Florida accident victims don’t automatically lose their right to damages if they share partial fault for an accident.  However, you will lose your right to damages if your portion of fault exceeds 50%.

Florida is a modified comparative negligence state.  Every person who is responsible for an accident will be assigned a proportionate share of fault. That includes you, as the accident victim.

If you’re assigned 50% or less of the blame, your damages award will be reduced by your percentage of fault.  You can recover your remaining damages from other parties who also shared fault for the crash.

What Causes Most Uber Accidents in Miami, Florida?

Miami residents and visitors often turn to Uber as a safer alternative to driving.  However, Uber drivers don’t have any specific training.  They’re just as prone to accidents as any other driver on the road.  In fact, because some spend long hours behind the wheel, they may be even more likely to cause an accident.

Some of the most common causes of Uber crashes in Miami and West Palm Beach include:

Of course, things like vehicle defects, hazardous road conditions and poor weather can also contribute to the cause of an accident–and it’s not always the Uber driver who’s liable.

How Long Do I Have to File a Lawsuit After an Uber Accident in Florida?

Florida Uber accident victims have two years to file a personal injury lawsuit.  Once this statute of limitations runs out, you’ll forfeit your right to sue for damages.

Prior to March 24, 2023, Florida accident victims had four years to pursue a legal claim pursuant to the state’s statute of limitations. However, if your Miami Uber accident occurred after that date, you’ll need to follow the two-year deadline.
