How Common Are Bicycle Accidents in Miami?

Florida consistently ranks as one of the most dangerous places in the United States for bike riders. In 2018, there were 148 fatalities and 6,175 injury accidents involving bicyclists in Florida.

Miami-Dade County has the highest number of bicycle crashes with motor vehicles in the state. Between 2008 and 2013, there were 3,854 bicycle crashes in the county. About 1 out of every 82 bicycle accidents caused a cyclist death.

According to a Dangerous by Design study, the Miami-Fort Lauderdale-Pompano Beach metro area is the 4th most dangerous city for bicycle riders and pedestrians in the U.S.

What is My Miami Bicycle Accident Case Worth?

Every injury case is unique and must be evaluated on its own merits.

To estimate the value of your case, we must consider the following:

  • Did you contribute to the accident or fail to mitigate your damages?
  • What is the total value of your current and future economic losses?
  • What type of injuries did you sustain, and how serious were they?
  • How will the accident affect your health, quality of life, ability to work, hobbies, and daily life?
  • How much insurance coverage is available?

Many other factors may also be important to your claim. Contact Shaked Law Personal Injury Lawyers for a free case evaluation today. Our Miami personal injury attorneys can help you understand how much your bicycle accident case may be worth.

What Damages Are Available to Bicycle Accident Victims in Miami, Florida?

You are entitled to seek compensation from the at-fault party after a crash. You can seek economic damages for your financial losses and non-economic damages for your personal, non-monetary losses.

The at-fault party may owe you money for your:

Your Miami bicycle crash lawyer will work with specialists to value the full extent of your losses. This process will give them the ammunition they need to fight for fair compensation.

Am I Still Entitled to Compensation if I Contributed to My Bicycle Accident?

Many motor vehicle accidents involve shared blame, including bike accidents. Under Florida’s modified comparative negligence rule, you can recover compensation for your injuries if your share of fault is 50% or less.

However, a jury may reduce your damages to account for your contributions to the crash. For example, suppose you suffered $50,000 in damages, but a jury assigns you 20% of the blame for your crash. In this case, your recovery will be reduced by 20% ($10,000) to $40,000. If a jury assigns you 51% of the blame, you wouldn’t be able to recover any compensation.

Insurance companies use this rule to shift as much blame as possible to injury victims. If they are successful, they can reduce the amount they need to pay for your claim – or avoid paying anything at all. If you are being blamed for the crash, contact a Miami personal injury lawyer as soon as possible to fight back.

What Causes Most Bicycle Accidents in Miami, FL?

Most bicycle accidents in Miami are caused by negligence or human error.

Common factors involved in bicycle accidents include:

A person riding a bicycle can also be at fault for a crash. The Miami-Dade Metropolitan Planning Organization found that 21% of cyclists in fatal crashes were impaired.

Many accidents involving a bicycle and a car or truck happen when a driver does not see a bicyclist. This can be due to blind spots, road features, or other vehicles obstructing a driver’s vision. While driving, the brain can fail to “see” a bicycle in plain sight because it monitors the road for other vehicles, not cyclists.

How Do I Prove Negligence After a Bicycle Accident?

A successful bicycle accident injury claim requires proving negligence. There are four elements of negligence.

You must show the defendant:

All motorists and cyclists owe others a duty to obey the law and drive/ride with reasonable care. Experienced Miami bicycle accident attorneys may use many forms of evidence to show the driver acted carelessly in causing your crash.

Potential forms of evidence may include:

  • Witness statements
  • Footage from dashcams and traffic cameras
  • Police citations
  • Accident reports
  • Photos of the scene of the crash and vehicle damage
  • Cell phone records of a suspected distracted driver

Shaked Law Personal Injury Lawyers will also work with specialists for expert testimony that strengthens your negligence case. Experts can provide testimony about the cause of your crash and the extent of your damages.

How Long Do I Have to File an Injury Lawsuit After a Bicycle Accident in Florida?

Florida’s statutes of limitation affect how long you have to file a personal injury lawsuit. These deadlines are strict; if you miss them, your case will be dismissed without consideration.

The statute of limitations after a bicycle or car accident is typically two years. You must file your case within two years from the date of your accident or risk losing compensation.

Note that state law used to give Florida personal injury victims four years to file a lawsuit. However, it was revised on March 24, 2023, giving less time to take legal action. Accordingly, if your Miami bicycle accident happened after 3/24/23, you’ll be subject to the two-year deadline.

The deadline for a wrongful death claim after a fatal crash is also two years. If you have a claim against a government entity, you may have an even shorter amount of time to provide notice and file your case.
