June 27, 2025 | Sagi Shaked | Personal Injury

Mopeds and other types of scooters have increased in popularity recently, especially in busy areas like Miami, FL. These vehicles are relatively inexpensive, and they can be a great way to get around the city.
Some people use these just for recreation, while others use them as their everyday method of transportation. State laws vary on whether moped drivers need a license, so keep reading below to learn whether you need a license for a moped in Florida.
What Is a Moped?
First, you must define what is meant by the term “moped.” There are so many variations of mopeds, scooters, and small motorcycles that it can get somewhat confusing to understand the laws that apply to each.
According to Section 320.01(27) of the Florida Statutes, a moped is “any vehicle with pedals to permit propulsion by human power, having a seat or saddle for the use of the rider and designed to travel on not more than three wheels, with a motor rated not in excess of 2 brake horsepower.”
Additionally, a moped cannot travel more than 30 miles per hour on level ground, and it must have an automatic drive system. Finally, if the moped has an internal combustion engine, it cannot be more than 50 cc in displacement.
Do I Need a License to Drive a Moped in Florida?
Yes, you do need a license to operate a moped in Florida. Mopeds are considered vehicles, so a license is required. However, you do not necessarily need a regular driver’s license.
You can operate a moped with:
- A regular driver’s license
- A Class E license
- A motorcycle-only license
It is also important to note that your moped must be registered in the state of Florida. This means that you will have to get a tag and register your moped with the Florida Department of Highway Safety and Motor Vehicles. A title is not required for mopeds in Florida.
Additional Florida Moped Laws
There are also some additional laws in Florida that pertain to mopeds. It is helpful to have a basic understanding of all the laws that may affect your usage of a moped prior to purchasing or riding one of these vehicles.
Helmets
Moped riders are not required to wear helmets or eye protection in Florida. However, wearing a helmet is always a good idea to avoid a brain injury in the event of an accident. If you are carrying a passenger who is 16 or younger, that passenger must wear a helmet at all times.
Insurance
Moped drivers are not required to carry insurance like a regular vehicle. However, you will still have liability if you cause property damage or injuries to another person.
Interstate Use
Additionally, mopeds are prohibited from driving on the interstate. These vehicles do not go fast enough to maintain the minimum speed requirements. Similarly, they are prohibited from lane splitting, and they cannot weave in and out of lanes to pass other vehicles.
Common Moped Accident Injuries
If you are involved in an accident on your moped, you could suffer some serious injuries such as:
- Brain injuries
- Broken bones
- Lacerations
- Severe road rash
- Back injuries
These types of injuries can lead to long-term physical, emotional, and financial challenges, making it important to seek medical care and legal support right away.
What to Do if You Are in a Moped Accident
Go ahead and seek immediate medical treatment for any injuries. Accidents involving injuries must be reported to the police, so go ahead and notify the local police department. They will send an officer to complete an accident report for you.
If possible, exchange information with the other driver. If they caused the accident, they may be responsible for all your damages. Gather as much evidence from the scene as possible, such as photos of all the vehicles involved and contact information of any witnesses.
Finally, talk to an experienced personal injury lawyer for help. A lawyer can help investigate your claim and determine all the damages to which you may be entitled. Never make a statement to the insurance company, especially the at-fault driver’s insurance, until you have talked to a lawyer.
